- Backfilling and grading of material from within Pit 1 and from mine site haul <br />roads to construct aneast-west trending ridge in the southern portion of Pit 1. <br />Tltis ridge shall geomorphologically connect the two north-south trending ridges <br />at the east and west edges of the pit; <br />- Grade the slopes within Pit 1 and the southeastern outslope of the east-west <br />ridge to a gradient of 3H:1V; and <br />- Construct post-mining drainage channels PD-3 (directing flow north out of <br />Pit 1), PD-4 (directing flow from the southern Pit 1 outslopes to the east), and <br />PD-5 (directing flow from the areas northeast of Pit 1 to areas south and east). <br />Additional matters to be considered by DMG in the course of conducting bond release <br />inspections are described in Section 3.03.2(2) of the Board's Regulations. These matters <br />include "the result of inspections and monitoring conducted pursuant to [Section] 4.05.13 <br />[surface water and groundwater monitoring] and [Section] 5.02 [DMG site and records <br />inspections], the degree of difficulty to complete any remaining reclamation, and whether <br />pollution of surface or subsurface water is occurring, the probability of future occurrence of <br />such pollution, and the estimated cost of abating such pollution." <br />III.. Review of Materials <br />Materials used in conjunction with the DMG review of the Phase I Bond Release Request <br />for Pit 1 of the Marr Mine include: <br />- The permittee's April 21, 1994 application for bond release; <br />- The DMG Marc Mine permit and pertinent associated revisions; <br />- Information gathered from DMG inspections conducted pursuant to the April 21, 1994, <br />bond release request; <br />- Reports from earlier DMG inspections; <br />- Annual Hydrology Reports (submitted by Kerr Coal Company to DMG) from 1982- <br />1994; and <br />- Information obtained from conversations held in January 1996 between DMG personnel <br />and representatives from the Colorado Water Quality Control Commission and the <br />Colorado Department of Health and the Environment (Water Quality Control Division). <br />IV. Summary of the Review Process <br />Kerr Coal Company submitted its Phase I Bond Release Request package to DMG on <br />March 18, 1994. Public notice regazding its submittal was published once a week for four <br />cotvsecutive weeks in the Jackson County Staz between March 17, 1994, and April 18, <br />1994. An affidavit of publication was received by the DMG on April 18, 1994. The <br />application was deemed complete by DMG on April 21, 1994. <br />-2- <br />
