INTRODUCTION <br />This document is the approval package prepared by the Colorado Division of Minerals and Geology <br />(Division) for approval of a partial Phase I bond release application submitted by Snowcap Coal Company <br />for the Roadside North and South Portals Mine, Permit # C-1981-041. The package contains three parts <br />including: (i) A summary of the review process; (2) Written findings of the Division regarding compliance <br />with the bond release requirements of the Colorado Surface Coal Mining and Reclamation Act (the Act), <br />and Regulations promulgated thereunder, and; (3) The proposed decision to approve, in part, the request <br />for partial Phase I bond release. <br />Detailed information about the review process can be found in the Act and Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining (the Regulations). All rules referenced within this <br />document are contained within the Regulations. Detailed information about the mining and reclamation <br />operations can be found in the permit application on file at the Division of Minerals and Geology, 1313 <br />Sherman Street, Room 215, Denver, Colorado 80203, or at the Division's field office at 101 South Third, <br />Suite 301, Grand Junction, Colorado 81504. <br />The Roadside North and South Portals Mine (Roadside) is an underground coal mine. Snowcap Coal <br />Company, Inc. (SCC) is the permittee and operator. The permit area surface lands and minerals are both <br />privately and federally owned. Most of the land for which bond release has been requested is privately <br />owned by SCC; a small portion of the surface is federally owned, managed by the Bureau of Land <br />Management (BLM). Coal extraction ceased in December 1999, and limited reclamation operations <br />began shortly thereafter. Large scale reclamation of refuse disposal areas and mining facilities was <br />undertaken in 2002, following SCC's acquisition of the permit from Powderhorn Coal Company, the <br />previous permittee. SCC's reclamation operations at Roadside are continuing, and with one exception, <br />final reclamation of all disturbed areas is scheduled to be completed by the end of 2004, in accordance <br />with the approved mining and reclamation permit. The one exception is that the unit train loadout and <br />associated electrical facilities have been approved for possible future use for rail loading of coal trucked <br />from other mines in the vicinity. <br />The total approved disturbance area at Roadside is 242.4 acres. In this partial Phase 1 bond release <br />application, the operator has requested Phase 1 bond release for completion of backfilling and grading, <br />topsoiling, partial completion of required facilities removal, and portal sealing, on 133 acres of the <br />approved disturbance. <br />The Division is proposing to approve the operator's request based on completion of facilities removal, <br />drainage control, and backfilling and grading as described in the bond release application. However, the <br />Division is not proposing any liability release "credit" for completion of topsoiling. In accordance with Rule <br />3.03.1(2)(a) and the Division's bond release guideline, liability release associated with topsoil <br />replacement is evaluated as a component of Phase II bond release, upon demonstration that a stabilizing <br />vegetation cover has been established on the topsoiled areas. Liability release "credit" for topsoil <br />replacement is not granted as a component of Phase I bond release. <br />SCC requested release of $1,575,242.82 of the current total bond amount of $3,264,149.00. Based on <br />evaluation of the application, field inspection, and calculation of the liability associated with remaining <br />reclamation the Division is proposing to release a total of $1,466,510.00, which is approximately 44.9% of <br />the current total bond amount. <br />Phase I Bond Release 3 August 15, 2003 <br />
