immediately downstream from the dip section culvert outlets. Permanent modifications were made at the <br />dip section structure, including installation of concrete wing-walls and dismantling of metal railing. The <br />interim channel segment was certified following completion (P.E. certification dated 6/21/02). The <br />segment has experienced some scour since completion, and there was some under-cutting of the riprap <br />bank protection. The area of undercutting had been properly repaired prior to the bond release <br />inspection. <br />The channel will be re-aligned in conjunction with removal of Sediment Ponds 6 and 10 to restore a <br />meander through the current Pond 6 location, prior to final Phase 3 bond release. The interim channel <br />stabilization measures within the permanent diversion segment, and the permanent modifications to the <br />dip section structure have been satisfactorily completed, and completion of this work will be <br />acknowledged in the bond release decision. Sufficient bond to cover the cost of restoring the permanent <br />meander as specified in the approved final reclamation design will be retained. The final reconstructed <br />channel segment will need to be included in a future phase 1 bond release application in order to effect <br />release or reduction of the associated bond. As noted for the North Portal ephemeral channels, the <br />operator committed in the approved permit to construct the approved permanent channel realignment at <br />least 3 years prior to final Phase 3 bond release. <br />Other Backfilled and Graded Areas <br />Various other small areas where backfilling and grading has been completed are included in the bond <br />release application and were viewed during the bond release inspection. <br />These areas include temporary refuse cover haulage roads on the northwest side of CRDA-1, former <br />Topsoil Stockpile sites 7 and 9 in the immediate vicinity of Pond 10 between Coal Creek and Haul Road <br />4, former Topsoil Stockpile sites 5 and 6, at either end of CRDA-1, former soil borrow area CBA-1, the <br />former Powder Cap and magazine pad and road east of CRDA-2, former Haul Road 2 between the Xcel <br />dozer shed and the reclaimed North Portal Area (excluding the riprap transition structure to be installed in <br />the Coal Creek channel at the former road crossing location), the Roadside Refuse Soil Borrow Area, <br />former South Mine upper diversion ditch, the drill pad disturbances associated with installation of the 016 <br />minewater discharge site, and the "B" Substation facility and borehole sites. <br />Most of these small areas were reclaimed during 2002, although Stockpiles 5 and 6 were reclaimed in <br />1993/1994. Based on information presented in the bond release application and observations made <br />during the bond release inspection, all of the areas appear to have been properly graded to blend in with <br />adjacent terrain, in conformance with the approved permit, and the regraded areas appear stable, with no <br />areas of excessive erosion. Three small ephemeral drainage channels were extended across the <br />RSRDA Soil Borrow area in accordance with the approved permit, and documentation of compliance with <br />design specifications is included in the April 15, 2003 DMG inspection report. Sediment controls remain <br />in place at most of these sites, with the exception of exempt road and diversion disturbances, and <br />Stockpiles 5 and 6 sites where vegetation cover was previously demonstrated to be adequate to control <br />sedimentation. Sediment controls including ponds, sumps, silt fencing andlor berms will need to be <br />eliminated once appropriate sedimentation demonstrations have been made, prior to final (Phase 3) bond <br />release. <br />(9) Drainage control for the reclaimed area, including approved upslope diversions. <br />Drainage and sediment control structures associated with each of the various locations for which Phase 1 <br />bond release was requested appeared to be properly maintained and functional. Disturbed area drainage <br />in each of the locations is either routed to a sedimentation pond or other permit specified sediment control <br />structure (containment sump, silt fence andlor berm), unless documentation has been provided that <br />vegetative cover or other site specific factors are sufficient to control sedimentation. Such locations <br />include former Stockpile Sites 5 and 6, and the short northeast facing slopes of CRDA-2 that drain into <br />the upland diversion ditch. Temporary diversion ditches, collection ditches, and perimeter berms are also <br />in place in the various disturbed and reclaimed areas subject to sediment control requirements, in <br />Phase I Bond Release 19 August 15, 2003 <br />
