Health and Safety: <br />27. Signs will be posted on the proposed project facilities that identify potential hazards associated <br />with their operation including noise, and explosive use. Material Safety Data Sheets for any <br />chemicals will be maintained on site during the construction phase. <br />28. Fire restrictions/guidelines during periods of high wildfire danger will be followed as required by <br />the Authorized Officer. <br />29. A monitoring and sampling plan will be submitted and approved to determine baseline radiation <br />levels in the Plan area and in any future modification area prior to, during mining and at <br />reclamation. The monitoring plan will include a description of monitoring devices, sampling <br />parameters and frequency, reporting procedures and methods. The monitoring plan will be <br />coordinated with and approved by the BLM Authorized Officer prior to surface disturbance. <br />30. If monitoring results indicate there are hazard levels of radioactivity on the mine site due to <br />mining activity, actions must be taken to prevent damage to public health, welfare and the <br />environment. <br />31. If the mine is to be idle for more than one year, the mine entrance must be closed using a method <br />sufficient to preclude entry by the public. Temporary closure methods must be approved by BLM <br />and CDRMS. <br />32. During final reclamation, the opening must be permanently closed using methods approved by <br />BLM and CDRMS. <br />Noise: <br />33. If noise exceeds Colorado noise emission limits (Colorado Regulation 25-12 Article 12, "Noise <br />Abatement") with any mining operations, adequate muffling techniques, such as hospital-type <br />mufflers, will be applied to reduce noise levels to an acceptable level. <br />Paleontology: <br />34. If paleontological materials (fossils) are uncovered during project activities, the operator will <br />immediately stop activities that might further disturb such materials, and contact the authorized <br />officer (AO). The operator and the authorized officer will consult and determine the best option <br />for avoiding or mitigating paleontological site damage. <br />Financial Guarantee <br />BLM will review and provide bonding recommendations and concurrence to the Colorado Division of <br />Reclamation, Mining and Safety (CDRMS) for the J Birds Mine Permit M-2005-050. Operations may <br />begin when BLM is provided documentation that the bond is filed with CDRMS and the permit is <br />authorized by CDRMS. You must not begin activities under the approved Plan of Operations until you <br />receive notification that your financial guarantee has been accepted and the requirements of the <br />Conditions of Approval have been met. <br />Approval of a Plan of Operations by BLM does not constitute a determination regarding the validity or <br />ownership of any unpatented mining claim involved in the mining operation. Rimrock Exploration & <br />Development Inc. is responsible for obtaining any use rights or local, state or federal permits, licenses <br />or reviews that may be required for the operation. <br />Occupancy <br />The J Birds Mine Plan of Operations involves placement of temporary structures. By this decision, <br />the BLM notifies you that your use and occupancy are reasonably incident and they conform to all of <br />the applicable requirements of 43 CFR 3715. Any failure to meet the requirements of the regulations <br />may result in a notica,of noncompliance or an order for you to suspend or cease your occupancy under <br />
