prehistoric archaeology sites, or for collecting artifacts of any kind, including historic items <br />and/or arrowheads and pottery fragments from Federal lands. <br />Invasive, Non-native species: <br />5. The operator is required to control weeds for the life of the Plan in accordance with Montrose <br />County weed regulations and the Colorado Noxious Weed Act. The operator will be required to <br />submit a Pesticide Use Proposal to the BLM prior to achial noxious weed control for approval of <br />herbicides or mechanical controls. As a safeguard to avoid the inadvertent invasion of noxious <br />weeds, vehicle(s) that have been driven in weed-infested areas should be cleaned with high <br />pressure spray equipment before entering non-infested areas. The operator and BLM staff will <br />monitor for noxious weeds and contact the applicant regarding treatment required. <br />6. Use of pesticides shall comply with the applicable Federal and state laws. Pesticides shall be used <br />only in accordance with their registered uses and within limitations imposed by the Secretary of <br />the Interior. Prior to the use of pesticides, the holder shall obtain from the authorized officer <br />written approval of the applicant's plan showing the type and quantity of material to be used, <br />pest(s) to be controlled, method of application, location of storage and disposal of containers, and <br />any other information deemed necessary by the authorized officer. The plan should be submitted <br />no later than March 1 of any calendaz year to cover the proposed activities for the next growing <br />season. Emergency use of pesticides shall be approved in writing by the authorized officer prior <br />to such use. <br />Threatened, Endangered, and Sensitive Species: <br />7. In the future, if water depletions associated with mining activities exceed 0.2 acre feet per year <br />evaluated in this document, BLM will be notified so that further water depletion payments, or <br />consultation with U.S. Fish and Wildlife Service can be initiated. <br />8. If, in the future, additional effects on species listed under the Endangered Species Act are evident, <br />consultation with the U.S. Fish and Wildlife Service may be reopened. <br />9. If the mine is to be inactive for more than one year, the portal will be closed in a manner- <br />sufficient to prevent colonization by bats. Closure of the mine opening during reclamation will <br />consist of a "permanent" closure, the design of which will be developed in cooperation with <br />CDRMS and BLM. Temporary and "permanent" closures should be installed in such a manner so <br />as not to entomb any stray bats that may have entered the workings, i.e. using netting that allows <br />exit, but not re-entry during a 24hr period. <br />Wastes/Hazardous or Solid: <br />10. Signs will be posted on site that identifies potential hazards associated with the mining operation <br />including chemical hazards. <br />11. The mine site will be designed in such a manner as not to allow offsite runoff water to enter the <br />pad. <br />12. Material Safety Data Sheets For any chemicals will be maintained on site. <br />13. Sanitary facilities will be required on location. <br />14. Any fuel spills will be immediately reported to the authorized officer, and copies of all <br />characterization and remediation spill data and reports will be filed within two days with the <br />authorized officer. Spill reporting, containment and cleanup will occur immediately and will be <br />removed to the nearest approved landfill. <br />15. All trash and domestic solid waste will be collected from the mine location and the surrounding <br />area and removed to an approved sanitary landfill. <br />
