<br />e~c services <br />Consuttin9 in Water Resources, Oams, and ConsfNCfion <br />March 12, 2007 <br />Mr. Steve Witte, PE <br />Division Engineer <br />Colorado Division of Water Resources <br />Water Division 2 <br />310 East Abriendo, Suite B <br />Pueblo, CO 81004 <br />Re: Administrative Approval for Proposed Wash Water Usage <br />Pine Ridge Pit (Leadville) -ACA Products, Inc. <br />Deaz Mr. Witte: <br />Per a recent phone discussion with Kalsoum Abbasi, please fmd below a request for <br />administrative approval for the temporary use of water to wash gravel at ACA Products' Pine <br />Ridge Pit near Leadville, just southwest of the Town of Malta, Colorado. More specifically, the <br />water will be used for the initial fill of the sediment pond (approx. 10 ac-ft); evaporation from the <br />pond (conservatively assumed to be I ft over 2 acres, or 2 ac-ft); and wash water contained within <br />the aggregate that leaves the site (assumed to be 4% by weight on 20,000 tons, or approx. 0.6 ac- <br />ft); for a total of approximately 13 ac-ft required. The water will be delivered to the site via a <br />diversion off of Half Moon Creek through the Templeton Ditch. <br />ACA Products (ACA) has leased 90 ac-ft of water from The Pueblo Board of Water Works <br />(Pueblo) to be delivered between June 1 and July 15`s. The balance between anticipated <br />consumptive use and water available for delivery is intended to cover ditch losses. Attached <br />please fmd a letter from Pueblo accepting ACA's proposal to lease the water. <br />Pueblo does not have a water right on Half Moon Creek and intends to replace water taken <br />through the Templeton Ditch dlrectly to the Arkansas River. The Colorado Water Conservation <br />Board holds a 7 cfs minimum in-stream flow right on Half Moon Creek to the confluence with <br />Lake Fork Creek that will have to be kept whole. As noted below in Figure 1 and Table 1, mean <br />daily dischazge at USGS Gaging Station 07083000 HALFMOON CREEK NEAR MALTA, CO <br />(approximately 1 mile upstream of the Templeton diversion) for the period of June 1 through July <br />15 ranges from 79 to 144 cfs. The period of record is 60-61 years from 1945-2006.
