<br />6 <br />Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release <br />application, and site inspections, the Division finds that H-G Coal <br />Company has completed backfilling, grading and drainage <br />reestablishment, in accordance with the approved reclamation plan, for <br />that portion of the Hayden Gulch Mine that is west of County Road 53. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to partially <br />approve H-G Coal Company's request for a Phase One bond release for <br />the Hayden Gulch Mine. This proposed decision will release the <br />applicant from liability for backfilling, grading and drainage <br />reestablishment for that portion of the Hayden Gulch Mine that is <br />located on the west side of County Road 53, as shown on Map 1, <br />"Facilities Area Reclamation Map", that was included in this bond <br />release submittal. <br />PHASE I <br />The Division holds a performance bond instrument of $2,300,000.00 for <br />the Hayden Gulch Mine. The H-G Coal Company's reclamation liability <br />for the entire mine site is $1,368,313.00, with the reclamation <br />liability for the portion of the mine site that is west of County Road <br />53 at $325,364.20. The Division proposes to release $108,046.73 for <br />the partial Phase One bond release for the west portion of the mine <br />site. The remaining $217,317.47 is sufficient to assure completion of <br />the remaining reclamation work at the west portion of the mine site if <br />the work had to be performed by the Division, including the cost of <br />reestablishing vegetation on any revegetated areas, should those areas <br />fail. The Division estimates its cost to complete remaining <br />reclamation work at the site to be $217,317.47. <br />Reclamation work which remains to be done at the west side of the mine <br />site, or which has not gone through the bond release process, includes <br />redistributing topsoil stockpiles A and B, revegetating 49.01 acres, <br />establishing shrub transplants and sealing wells. <br />Any person with a valid legal interest which might be adversely <br />affected by this proposed decision may request a formal public hearing <br />before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published <br />twice in the Steamboat Pilot as soon as possible. Requests for public <br />hearing must be submitted to the Division in writing within thirty <br />days of the first publication in the Steamboat Pilot.
