<br />4 <br />David Berry and Joseph J. Dudash of the Division of Minerals and <br />Geology attended the bond release inspection. The Office of <br />Surface Mining did not send a representative to this inspection. <br />The Division's inspection report dated October 9, 1996 details <br />the results of the Phase One Bond Release Inspection for the west <br />side of the mine site. Several adequacy issues were raised in <br />that inspection report. Some of the adequacy questions involved <br />work in the field. Other adequacy questions were concerned with <br />the submittal of additional information. The operator responded <br />to those adequacy questions with additional field work and a <br />submittal dated April 8, 1997, and received at the Division on <br />April 10, 1997. The additional field work was inspected and <br />approved by Division personnel and documented in inspection <br />reports dated November 6, 1996, May 22, 1997 and June 3, 1997. <br />The additional submittal of information was reviewed in the <br />Division office in May of 1997, and approved. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />PHASE I <br />Rule 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond <br />amount shall be released when the permittee successfully completes <br />backfilling, regrading, and drainage control in accordance with the <br />approved reclamation plan." With regard to partial Phase One bond <br />release, the approved reclamation plan for the Hayden Gulch Mine calls <br />for the dismantling and removal of the structures associated with <br />mining activities, removal of topsoil stockpiles, backfilling and <br />grading of the facilities area and former topsoil stockpile areas, and <br />the reestablishment of the drainage system. <br />III. OBSERVATIONS AND FINDINGS <br />PHASE I <br />The mine related structures were removed in the late summer of 1987. <br />These structures included the shop/warehouse building, office <br />building, bathhouse, sewage disposal system, the fuel storage <br />facility, the explosive storage facility, power poles and equipment <br />wash facility. The concrete pads beneath the office and shop buildings <br />were fractured and buried in place, under five feet of fill, before <br />topsoiling. The only mine related structure remaining in the field is <br />the telephone junction box, located just northwest of pond 3. The <br />operator reported that the telephone company has been notified of the <br />need to remove this junction box. <br />Topsoil stockpiles A and B were depleted in the fall of 1987. The two <br />areas were regraded during this same time. what remains of the area <br />designated as topsoil stockpile C appears to be a topsoil layer placed <br />
