Harvard Ave. <br />Denver, Colorado 80231 <br />Re: Stipulation No. 12 to Permit No. C-005-81 <br />Shrub Desity Standard <br />Dear Mr. Wainwright: <br />Seneca Coals, Ltd. has adequately regTOnded to stipulation No. 12 of <br />permit No. C-005-81. This stipulation required the establishment of <br />an acceptable shrub density standard. Seneca Coals, Ltd. has proposed <br />an average of 1000 stems/acre overall some of the reclaimed areas will have <br />higher or lower densities since it is an overall average. The Division <br />agrees with Seneca Coals, Ltd. that this level of shrub establishment <br />will provide a good balance of wildlife habitat and livestock grazing. <br />To establish a feasible density standard Seneca Coals, Ltd. conducted a <br />study at the Seneca II mine in 1982 titled "Native Shrub Regeneration <br />on Reclaimed Lands of a Surface Coal ~1ine in Northwestern Colorado". The <br />study was well done and concluded that if the proper reclamation methods <br />were implemented, 1000 stems/acre is a feasible standard. Permanent <br />transects will be located during 1983 to better evaluate and document <br />the trends of woody plant establishment reported in the 1982 study. <br />Results from the report and the continuing study will help the company <br />and the Division in better understanding the nature of shrub establishment <br />on reclaimed lands. <br />The Division appreciates Peabody Coal Company's cooperation and interest <br />in resolving this stipulation. <br />Sincerely, <br />~LLI `-r~~t~ '1`'`~~s`1 ,, z r ~ ~~ 1 <br />Sandra L.
