<br /> <br />The DP4G encouraged the operator to contact the Colorado Department <br />of Public Health and Environment, Water Quality Control Division <br />(WQCDi to obtain a CDPS discharge Permit. As I informed you in our <br />telephone conversation today, there is no evidence that EWM did so. <br />Consec;uently, if you take over this permit, you may be required to <br />obtaixx the discharge permit before any discharge occurs from the <br />Phil :3heridan Tunnel. In addition, I believe the WQCD informed <br />Rocky Conner of EWM that the operator would be found in violation <br />if an~r discharges occurred from the tunnel prior to obtaining the <br />CDPS F~ermit. A violation of this type could involve costly fines <br />and corrective actions. I suggest you call Phil Hegeman of the <br />WQCD a.t (303)-692-3598 to discuss the situation before you transfer <br />the permit. <br />I have enclosed copies of the May 24, 1996 and June 3, 1996 <br />inspection reports referenced above and the succession of operator <br />forms you requested.
