Box 68 <br />Craig, CO 81625 <br />Re: Stipulations to Permit No. C-044-81 <br />Dear Mr. Mills: <br />The purpose of this letter is to advise you of the status of the stipulations <br />attached to the September 2, 1983 findings document. There were twenty-four <br />(24) stipulations. Stipulations 1, 8, 12, 14, 15, 17, and 24 do not require <br />responses. The remaining stipulations are discussed below in numerical order. <br />Stipulation No. 2 <br />This stipulation required Empire Energy to submit and analyze results of <br />the Eagle No. 5 Mine sump study. The requested information was <br />submitted in a timely manner by Empire. The narrative within this <br />submittal does not describe the location within the sump that the sump <br />water sample was collected, only that the sample had a residence time of <br />up to 54 days. Based on the information submitted, the results of this <br />study appear inconclusive. However, all points outlined within the <br />stipulation were addressed; therefore this response is considered <br />adequate and acceptable. <br />Stipulation No. 3 <br />This stipulation was modified from the September 2, 1983 findings <br />document for the April 9, 1984 findings document to require annual <br />inflow studies for both the Eagle No. 5 and 9 Mines. <br />In a letter from Empire Energy Corporation, dated May 1, 1984, Empire <br />requested that the Division reconsider the necessity of conducting <br />annual inflow studies for the No. 5 Mine workings. This is based upon <br />the argument that Empire believes its predictions relating to the <br />hydrologic balance can be verified by monitoring the discharge from the <br />mine, and if the discharge exceeds a threshold level (i.e., 20% above <br />the annual projected discharge), an inflow study would then be warranted. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
