<br />Sec. 2 The permittee is authorized to conduct surface coal mining and
<br />reclamation operations (as defined in 30 CFR 700.5 to include
<br />underground operations) for the "E" Seam on the following described
<br />Federal lands (as shown on ownership map) within the permit area at
<br />the Aawk's Nest Mine situated in the State of Colorado, Gunnison
<br />County, and located 12 miles northeast of Paonia, and approximately 3
<br />miles east of Somerset, Colorado:
<br />Lease C-17130: T. 13 S., R. 90 W., 6th P.M., sec. 2, lots 16, 17;
<br />sec. 3, lots 13, 14, 17, 18.
<br />Lease D-056724: T. 13 S., R. 90 W., 6th P.M., sec. 10, lots 1, 2,
<br />NE1/4SE1/4; sec. 11, lots 4, S.
<br />Lease D-042921: T. 13 S., R. 90 W., 6th P.M., sec. 1, lots 15, 16,
<br />17, 18; sec. 2, lots 13, 14, 15, 18, 19, 20; sec. 11, lots 1, 2, 3,
<br />9, SE1/4NW1/4, S1/2NE1/4; sec. 12, lots 3, 4, SW1/4NW1/4, NW1/4SW1/4.
<br />Lease C-27103: T. 13 S., R. 90 W., 6th P.M., sec. 1, lots 13, 14,
<br />19, 20; sec. 12, lots 1, 2, and those parts of 5, SW1/4NE1/4 and
<br />SE1/4NW1/4 north of the North Fork of the Gunnison River.
<br />and to cond•lct surface and reclamation operations connected with
<br />~~~ mining or. the foregoing described property subject to the conditions
<br />~ of the leases, the approved mining and reclamation plan (MRP), and
<br />~'- Colorado State permit C-016-81, including all stipulations, and all
<br />other applicable conditions, laws and regulations.
<br />Sec. 3 This permit is issued for a term of 5 years commencing on the date
<br />the permit is signed by the permittee, except that this permit will
<br />terminate if the permittee has not begun the surface coal mining and
<br />reclamation operations covered herein within 3 years of the date of
<br />issuance.
<br />Sec. 4 The permit rights may not be transferred, assigned, or sold without
<br />the approval of the Director, OSM. Request for transfer, assignment,
<br />or sale of permit rights must be done in accordance with 30 CFR
<br />740.13(e).
<br />Sec. 5 The permittee shall allow the authorized representatives of the
<br />Secretary, including, but not limited to, inspectors, fee compliance
<br />officers, and [he Colorado Mined Land Reclamation Division without
<br />advance notice or a search warrant, upon presentation of appropriate
<br />credentials, and without delay to:
<br />a. Have the rights of entry provided For in 30 CFR 840.12 and
<br />842.13; and,
<br />~" ~ b. Be accompanied by private persons for the purpose of conducting
<br />'~ an inspection in accordance with 30 CFR 842, when the inspection
<br />--~ is in response to an alleged violation reported by the private
<br />person.
