ICT.D <br />ON EXHi3IT 2.05.0-C, UNTIi CESS?~TIOiy OF btONiTORIPIG IS APPROVED, IN <br />'dRITLYG, 3Y THE DIVISION. <br />STIPULATION N0. 21 - Coal Lease C-17130 <br />In consultation with BLM all existing structures within Lease <br />C-17130, within 60 days and any new structure shall be colored, <br />painted, covered or finished in a manner that will blend with <br />the landscape character of the vicinity. <br />STIPULATION N0. 22 - Coal Lease C-27103 <br />An inventory of the tract for significant paleonltologic <br />- resources will be made and approved by the District Manager <br />prior to mining coal from the Lease (30 CFR 710.11). If such <br />resources are found, the mining permit will be modified to <br />protect such resources or a salvage plan will be devised and <br />made a part of the mining permit. <br />STIPULATION N0. 23 <br />Baked on current projections, subsidence is not expected to be a <br />- problem at the Hawk's Nest Mine, however, if monitoring efforts <br />- indicate that subsidence will be a factor the operator shall <br />ensure that a survey for cultural resources is performed on all <br />area-.where there is an indication of subsidence. Emphasis <br />should be directed towards the determination of the presence or <br />absence of sites which may be sensitive to the adverse effects <br />of subsidence, e.g., historic and prehistoric stuctures and/or <br />structural remains, rock shelters and rock art sites. If such <br />resources are located further survey may be necessay. Should <br />sites which may be sensitive to subsidence be located, the <br />operator will consult with the regulatory authority to determine <br />whether mitigation measures or monitoring activities are <br />necessary .o either avoid adverse impacts or determine whether <br />the site will be impacted by subsidence. <br />~~ <br />
