Box 758 <br />Greeley, CO 80632 <br />RE: Use of a conveyor to transport material from the Heiner Gravel <br />Pit to adjacent land, Permit No. M-77-151. <br />Dear Mr. Carroll: <br />Thank you for contacting the Division of Minerals and Geology and <br />explaining what Weld County wants to do to transport material from the <br />Heiner Gravel Pit to adjacent land owned by Weld County. The fax <br />explaining this upcoming operation was received on April 17, 1995. <br />The Division does not see the operation of using a temporary conveyor <br />to transport material from the mine permit area to the county property <br />as needing any modification to the present permit document. However, <br />the operator and Weld County should make sure that all excavation and <br />removal of material take place only on the presently permitted area <br />and that the stockpile formed by the conveyor is used only on the <br />upcoming fill on county land. That is, the material conveyed must be <br />used only on the county land and not transported to other projects. <br />If it was transported to other projects, then the stockpile could be <br />construed to be a part of the mining operation as defined in the <br />Colorado Mined Land Reclamation Act. <br />If you have any questions, please contact me. <br />Sincerely, <br />Carl B.
