Dept. of Natural Resources <br />T1IIS AG REEP~NT is entered into tliis'n€tth~ad~e~nbe"i'i!L~, <br />1973 by and between Tk1E STATE OF COLORADO, by and through its Director of <br />Natural Resources and the Land Reclamation Board (hereinafter referred to <br />as "State") and TIIE CANON COAL CORPORATION (IiereinaEter referred to as <br />"Canon"). <br />W I T N E S S E T H: <br />i, <br />WHEREAS, Canon has submitted a plan on the Proposed Land Stabili- <br />zation and Reclamation Procedures for the proposed coal mine operations; <br />and, <br />WFIEREAS, said coal mine will be operated for the purpose of ex- <br />tracting coal for commercial marketing and, <br />WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br />statutory authority for the Land Reclamation Board of the State of Colorado <br />to enter into agreements with operators or parsons in charge of mining <br />operations such as those contemplated by Canun to insure that the necessary <br />stabilization and reclamation work will be dune to prevent landslides, <br />floods or erosion. This section of the law further provides that the Land <br />Reclamation Board requires a performance bond conditioned upon the faith- <br />ful performance of the stabilization work reyuired by the Board; and, <br />WHEREAS, the Land Reclamation Board has determined that tt~e <br />mining operation to be conducted by Canon in said section 24 could have <br />an adverse affect on the environment and could result in landslides or <br />erosion if proper stabilization and reclamation procedures are not followed, <br />.~ 1- <br />---1: I / <br />:~ <br />
