Agreement Draft - we feel that this agreement should be between the Raikoad and <br />Contractor and could be included in the Right of Entry. <br />Pazagraph 3 -first sentence change words "as short a time as practical" to '.'a maximum <br />period of fourteen calendar days beginning no later than 6.00 AM <br />February 14, 1994" <br />Paragraph 4 -totally unacceptable as this is well beyond the liability that was expressed <br />in the bid documents. It could be re-written something like the following: <br />"Allowable closure time for tracks is as follows: Southernmost - 48 <br />cumulative hours during the period that demolition work is in progress. <br />Northernmost -fourteen calendar days beginning no later than 6.00 am <br />February 14, 1994. Should either period be exceeded then the Contractor <br />shall be liable for the payment of $1,000.00 per hour per track for each <br />hour that the allowable closure time is exceeded". <br />We look forward to your eazly response to these matters. <br />Yours truly, <br /> <br />D.
