Long <br />Drvaion Direcbr <br />The Division has concluded in part its investigation into Basin Resources, <br />Inc.'s underground mining operations occurring at the Golden Eagle Mine, <br />located approximately four miles west of Weston, Colorado in <br />Las Animas County, Colorado. We would like to reiterate the concerns raised <br />in your letters of December 7, 1992 and April 9, 1993, as we understand them, <br />provide responses to them, and provide a list of additional information needed <br />to complete our investigation. <br />Your first letter listed the following concerns: <br />Raton West - Baldwin Ltd. was not directly informed of Basin Resources' <br />plans to extract coal from under Raton West property until June 18, 1992; <br />2. Trinidad National Bank, from whom Mr. Charles R. Baldwin purchased the <br />property on December 31, 1991, was also never informed of Basin Resources' <br />mining plans; <br />3. The failure of Basin Resources to advise the surface owners of its mining <br />plans has resulted in serious problems for Raton West's intended use of <br />the property for residential development; <br />4. The entire permit proceeding should be reopened to allow Raton West full <br />ability to comment and respond to all aspects of Basin Resources' mining <br />plan which could impact Raton West property; <br />5. Any indication that the Division has been advised that Basin Resources <br />intends to undermine the Rancho Escondido subdivision can't be found; <br />6. Part of the subdivision may have already been undermined; <br />7. There are at least sixteen other owners of overlying land who have not <br />been listed in the permit applications and who have not received notice of <br />Basin Resources' operations; <br />
