HISTORY OF THE REVIEW PROCESS <br />The original permanent program permit application for the Nucla Mine was <br />submitted by Peabody on January 9, 1981. The Division proposed to approve the <br />application as detailed in the Proposed Decision and Findings of Compliance <br />Document dated April 14, 1983, and Permit No. C-81-008 was issued on May 26, <br />1983 fora five-year term. The Nucla Mine permit was renewed for a second <br />five-year term on May 6 , 1988. <br />On April 29, 1988 Peabody submitted an application for Permit Revision No. 2, <br />and the application was deemed complete on May 5, 1988. The revision proposed <br />to add a 219.9-acre Nucla East mining area to the permit area. Following a <br />long period of adequacy review and exchange of information between the <br />Division and Peabody, and following an Informal Conference held to address the <br />concerns of local residents, the Division proposed approval of the <br />Permit Revision on February 28, 1989. No objections were received by the <br />Division during the subsequent 30-day public comment period, and the <br />Division's proposed decision became final. <br />Peabody on September 12, 1989 and April 3, 1990 submitted required notices of <br />Temporary Cessation for the Nucla Mine. I{ydrologic and revegetation <br />monitoring, periodic inspection of certified structures, and site maintenance <br />have been the only activities since that time. <br />DESCRIPTION OF THE ENVIRONMENT <br />The Nucla Mine permit area encompasses 646:5 acres, including 219.9 acres at <br />Nucla East which has not at this time been disturbed. Land in the surrounding <br />areas is Dut mainly to irrigated and non-irrigated agrialtural use. <br />3 <br />
