Connolly, the Chapter 7 <br />Trustee for the above captioned Estate, has filed with the Court <br />his Motion to Sell Property Free and Clear of Liens, Claims, <br />Encumbrances and Other Interests Pursuant to Sections 363 (b) and <br />(f) (the "Motion"). The Motion proposes taking action as follows: <br />To sell all or substantially all of the Debtor's real property <br />and water rights, if any, on an AS IS, WHERE IS basis with no <br />representations or warranties of any kind, free and clear of liens, <br />claims, encumbrances, and other interests, with such liens, claims, <br />encumbrances, and other interests attaching to the proceeds of sale <br />as provided for in the Motion. Except as provided below, the sale <br />will be to Kim Haarberg and Jim Anttonen or their designee (the <br />"Buyer") for the purchase price of $367,500.00 payable by earnest <br />money deposit of $50,000.00 received at signing of the Contract, <br />and of $317,500.00 payable in cash at closing. <br />The proposed sale is subject to competitive bids. Additional <br />offers must be an amount equal to or greater than 105% of the above <br />purchase price. Offers by prospective purchasers must be submitted <br />in writing to the Trustee or his undersigned counsel at least three <br />(3) business days prior to the hearing on the proposed sale. All <br />offers must be submitted with the agreement to make a refundable <br />earnest money deposit in a form and in a commercially reasonable <br />amount to be held by the Trustee' s real estate agent in escrow <br />pending the results of the court's hearing on approval of the <br />Motion and Sale of the Debtor's real property. <br />A hearing on the Trustee's Motioa to sell the Property will be <br />held on January 7, 1997 at 1:30 p.m. is Courtroom B, United States <br />Bankruptcy Court for the District of Colorado, 721 19th Street, <br />Deaver, Colorado 80202.
