the approved plan. Ho surface or sub-surface water pollution due to mining at this site has been <br />identified through past monitoring. The applicant has removed Pond 5 and the three ponds which <br />comprised the Pond 2 series. Both of these structures were mine dewatering treatment ponds and did <br />not control surface runoff from the disturbed area. Pond 3 and Pond 4 remain in-place to control <br />sedimentation at the site until permanent vegetation is established. At the present time, these ponds <br />are nearly dry, indicating a reduced amount of runoff from the reclaimed areas as compared to <br />runoff during active mining. <br />[n summary, BRI has completed the reclamation plan with regard to backfilling, grading, and <br />drainage control as currently approved in the permit. The reclaimed area appears stable with no <br />signs of erosional problems beyond what would be expected after one year of reclamation. The <br />reclaimed azea blends well into the surrounding area. The difficulty in completing the remaining <br />reclamation is low. One to three power poles owned by the San Isabel Power Company need to be <br />removed in the vicinity of the intake fan site. The guard shack concrete stab needs removed from <br />the site. Pond 3 and Pond 4 will require removal when it is demonstrated that they aze no longer <br />necessary. <br />Based on the observations and findings as detailed above, the Division proposes to approve Basin <br />Resources Inc.'s request for a Phase I bond release at the Golden Eagle Mine. The reclamation <br />liability will be reduced by $676,874.00, which is sixty percent of $1,128,124.00. This leaves <br />$451,250.00 of reclamation liability remaining, to which it is necessary to add back the full <br />reclamation liability for the Third North vent and the NW-1 vent, shown above in Table B. This <br />leaves a total reclamation liability after approval of this bond release (SL-01) of $477,085.00. The <br />remaining bond is more than sufficient to cover the remainder of the reclamation tasks, including re- <br />seeding, in the unlikely event that it is necessary. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public heazing before the Mined Land Reclamation Board in accordance with <br />Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Huerfano <br />World for two weeks as soon as possible. Requests for public heazing must be submitted to the <br />Division in writing within Chitty days of the first publication of the public notice. If no hearing is <br />requested the Division's decision will become final. <br />
