<br />8 <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Trapper Mining Inc.'s request for <br />a Phase One partial bond release for the Trapper Mine. This proposed decision will release the <br />applicant from liability for backfilling,grading, and drainage reestablishmentfor those areas designated <br />on Map 1.0 of the bond release submittal. The Division also proposes to approve the release from <br />Phase One liability of the 59 livestock tanks converted to permanent impoundments that are shown on <br />Map 2.0 and listed in Table 2.5-1 of the bond release submittal. Those listed include the 56 water tanks <br />which do not have an asterisk by their designation, plus water tanks JW20, NNEI l and NNE14. <br />The Division holds a performance bond of $17,500,00.00 for the Trapper Mine. The approval of the <br />Phase One partial bond release is only a release from the liability of lackfilling, grading and drainage <br />reconstructionfor those acreages involved, as well as for the 59 permanent impoundments. No bond <br />money will be released so there will be no reduction in the bond amount. The current bond amount will <br />remain intact and is sufficient to assure completion of the remaining reclamation work at the ste if the <br />work had to be performed by the Division, including the cost of reestablishing vegetation on any <br />revegetated areas, should those areas fail. The Division estimates its cost to complete the remaining <br />reclamation work at the site to be $17,500,000.00. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published twice in the Craig Daily Press as <br />soon as possible. Requests for public hearing must be submitted to the Division in writing within thirty <br />days of the first publication in the Craig Daily Press. if nohearing is requested within that thirty days, <br />the Division's decision will become final. <br />c: \wp61 \trapper\bond fnd 1 <br />
