2 <br />Introduction <br />This document is the proposed decision of the Colorado Division of Minerals and Geology (the <br />Division) in response to a request for Phase One partial bond release at the Trapper Mine, Division <br />file number C-81-010. The package contains four parts. These include: 1) procedures and summary <br />of the bond release process; 2) criteria and schedule for bond release; 3) observations and findings of <br />the Division regarding compliance with the bond release requirements of the Colorado Surface Coal <br />Mining Reclamation Act (Act) and regulations promulgated thereunder; and 4) the Division's proposed <br />decision on the request for bond release. <br />Detailed information about the review process can be found in the Act and the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining (Regulations). All rules referenced within <br />this document are contained within the Regulations. Detailed information about the mining and <br />reclamation operations can be found in the permit application on file at the Division offices, located <br />at 1313 Sherman Street, Room 215, in Denver, Colorado. <br />The Trapper Mine is a surface mine which was permitted and operated by Trapper Mining, Inc. <br />Trapper Mine initially submitted a Phase One and Phase Two partial bond release request. However, <br />due to time constraints on a Phase Two adequacy issue, Trapper requested, in a letter dated Decerber <br />23, 1997 and received at the Division on December 26, 1997, that the Phase One partial bond release <br />request be separated from the Phase Two partial bond release request. The Division agreed with <br />Trapper's request. This Proposed Decision and Findings of Compliance document is for the Phase Ore <br />partial bond release only. A separate Proposed Decision and Findings of Compliance documentfor the <br />Phase 'Two partial bond release will be issued at a later date. The land for which Phase One partial <br />bond release has been requested is private and state owned and coal which was mined from the area <br />was private, state, federal and county owned. Reclamation for which Phase One partial bond release <br />has been requested was conducted from 1980 through 1995. Trapper submitted the Phase One partial <br />bond release package utilizing the Division's Guideline Regarding Selected Coal Mine Bond Release <br />/slues, dated April 18, 1995. This bond release is only a release from Phase One reclamation work <br />liability on those lands specified in these findings. No adjustment in the dollar amount of the bond wig <br />be necessary. <br />
