Nucla, C-81-006; Seneca II, <br />C-80-005; Seneca II-W, t=8~3-~ <br />Dear Mr. Lunan: <br />A recent inspection at the Seneca II-W Mine revealed that Peabody presently <br />has one million dollars of personal injury and property damage insurance to <br />cover all operations in the State of Colorado. Rule 2.03.9 requires that <br />"Minimum insurance coverage.., shall be 5300,000 for each occurrence and <br />5500,000 aggregate. This rule has been interpreted by the Division to mean <br />that each permit must have this coverage. Since Peabody wishes to cover all <br />three permitted mining operations with one insurance policy, total coverage <br />must be one and one-half million dollars.
