Long <br />rvision Dueuor <br />RE: Hawk's Nest Mine Backfilling and Drainage Control Projec <br />RN-MINES-COAL-10 <br />Dear Mr. Wiseman, <br />The Colorado Division of Minerals and Geology is proceeding with <br />the final phase of reclamation at the Hawk's Nest Mine. The <br />operator of the mine, Western Slope Carbon Inc. failed to meet the <br />regulatory requirements for an extended period of time. This <br />failure to comply resulted in revocation of the mining permit and <br />forfeiture of the reclamation performance bond being held by the <br />Division. The Division has the statutory and regulatory <br />responsibility and authority to ensure that satisfactory <br />reclamation of lands affected by coal mining occurs in the State of <br />Colorado (Colorado Surface Coal Mining Reclamation Act 34-33-104 <br />C.R.S.). As part of the reclamation process, the Division needs to <br />provide notification of the impending reclamation work to all <br />surface owners of the area to be reclaimed. <br />The reclamation work involved includes regrading the remaining coal <br />material on site, topsoil replacement, revegetation, sediment pond <br />removal, channel reconstruction and sealing and plugging four (4) <br />methane degasification wells. <br />Work in this area is scheduled to begin in late September and end <br />in early November.
