Reclamation Board. The (Board) and the Division were ordered by the State Auditor to review all <br />reclamation bonds and contacts for all NOI hard rock prospecting operations. The Boazd-ordered process <br />was that if contact could not be made with the prospector, the bond should be forfeited and the prospect <br />terminated. Thus, since there was no response within the specified time, the surety was notified of <br />possible bond forfeiture. <br />I am not sure what you are referring to in the third paragraph of your July 271etter. The Emma Lode does <br />not require an annual fee since it is a prospect (NOI). <br />Regarding the annual fee assessment report matter brought up in your letter of July 27, 2005, the DMG <br />thanks you for bringing this to our attention. As with all organizations, sometimes errors occur. I can <br />assure you that our Mr. Dupler makes every effort to perform his job in a professional and efficient <br />manner. When errors occur, we try our best to correct the situation to the extent that the law, rules, and <br />regulations allow. I understand that this situation has also been resolved. <br />In partial response to your letter and at his suggestion, I directed Mr. Mount to re-inspect the Gold Basin <br />Mine on August 23, 2005 to help define pre-permit disturbance from post-permit disturbance so you would <br />not be held responsible for any land you did not disturb. I have read Mr. Mount's inspection report and <br />concur that DMG can offer you two options to solve the regulatory problem, which is, the disturbed land is <br />presently out of the permit boundary marked on the ground: <br />1) Since only 1.3 acres has been actually disturbed by the mining operation, you could relocate the <br />stakes to include all present and proposed future mining disturbances at the site. However, the <br />total azea encompassed by the revised permit boundary must not exceed the presently approved <br />3 acres and must occur within your property limits. The Division would then verify stake <br />placement at a later date; or <br />2) You could submit the necessary documents to make the previously submitted incomplete <br />amendment application complete and proceed to approval of that application and get the <br />requested 9.99 acres of permit area to include the 1.3 acres of already disturbed azea. You <br />should also include any other azeas that would have to be disturbed by future mining and <br />reclamation activities. (Again, we will not chazge you the amendment fee.) Such information <br />to make the amendment complete includes: <br />a. A completed application form, <br />b. Proof of filing with the County Clerk, <br />c. Proof of Mailing Notices of Amendment Application to the County Board of <br />Commissioners and the Boazd of Supervisors of the local Soil Conservation District, <br />and <br />d. An affidavit of Posting Notice at the mine site. <br />In reference to the amendment forms, I understand that amendment forms were sent to you. If you still <br />want to do an amendment, and you did receive them, or if you have questions concerning the amendment <br />forms, please call either Mr. Mount or me. Our intent is to help you through the amendment process if that <br />is the direction you would like to take. <br />
