Cattany
Dear Mr. LBWlckl: Atting Division Director
As we discussed on the phone today, the following sequence of events would lead to bond release at the Apex Mine
(assuming adequate submittals and field verification).
1. Operator submits a Technical Revision to DMG (Division of Minerals and Geology) that: a) demonstrates the
pond and east berm are no longer necessary for sedimentation control, and b) removes from page 183 of the
permit application the requirement to achieve Phase II release prior to removing the pond.
2. DMG verifies the Colorado Water Quality Control Division has no objection to the proposed pond removal.
3. DMG approves the Technical Revision.
4. Operator reclaims the pond and east berm as described on page 183 of the pemut application.
5. Operator submits a Phase IUIII partial bond release application requesting release of all but $10,000 of remaining
bond (this application can be submitted before the Technical Revision is approved). The $10,000 bond will
remain for reclamation of the pond and the east berm. The amount of the bond is $10,000 because Section
3.02.2(3) requires that no bond be less than that amount.
6. DMG conducts the bond release inspection.
7. DMG approves the bond release application and releases all but the $10,000 of bond.
8. DMG conducts a final inspection in late Spring 2003 of the pond and east berm for compliance with Section
3.03.1(5) [vegetation that is sufficient for erosion control and is similar to reclaimed area].
9. DMG releases the final $10,000 of bond.
If you have any questions, please do not hesitate to call me.
Sincerely,
T~ ~~r~
Tom Kaldenbach
Environmental Protection Specialist
cc: Dan Hernandez, DMG
