Cattany <br />Dear Mr. LBWlckl: Atting Division Director <br />As we discussed on the phone today, the following sequence of events would lead to bond release at the Apex Mine <br />(assuming adequate submittals and field verification). <br />1. Operator submits a Technical Revision to DMG (Division of Minerals and Geology) that: a) demonstrates the <br />pond and east berm are no longer necessary for sedimentation control, and b) removes from page 183 of the <br />permit application the requirement to achieve Phase II release prior to removing the pond. <br />2. DMG verifies the Colorado Water Quality Control Division has no objection to the proposed pond removal. <br />3. DMG approves the Technical Revision. <br />4. Operator reclaims the pond and east berm as described on page 183 of the pemut application. <br />5. Operator submits a Phase IUIII partial bond release application requesting release of all but $10,000 of remaining <br />bond (this application can be submitted before the Technical Revision is approved). The $10,000 bond will <br />remain for reclamation of the pond and the east berm. The amount of the bond is $10,000 because Section <br />3.02.2(3) requires that no bond be less than that amount. <br />6. DMG conducts the bond release inspection. <br />7. DMG approves the bond release application and releases all but the $10,000 of bond. <br />8. DMG conducts a final inspection in late Spring 2003 of the pond and east berm for compliance with Section <br />3.03.1(5) [vegetation that is sufficient for erosion control and is similar to reclaimed area]. <br />9.
