Non-compliance of <br />these requirements is a direct violation of the Rules and Regulations and State Statutes. The possible <br />acceptance of the construction of some of these facilities will be appazently based on very little design and <br />construction documentation and will be made without construction oversight of the original construction by this <br />office. This is not a practice that we either endorse or plan to continue. Please be advised that continuation of <br />this practice on future projects may result in this office informing the State Attorney General's office of this <br />activity, which could result in legal action being taken against the dam owner and/or the design engineering <br />firm involved with the project. The Colorado Board of Registration for Professional Engineers and <br />Professional Land Surveyors may also be informed about these activities, which could result in disciplinary <br />action being taken against the professional engineers responsible for the project. <br />The construction of this project must be performed under the purview of a professional engineer <br />registered in the State of Colorado. Your attention is duected to Rule 9.C. (copy enclosed) of the Rules and <br />Regulations concerning construction observations, coordination and documentation activities required for this <br />Intermediate size, Class 3 dam. Please keep Mr. Mark Haynes of our Denver office at (303) 866-3585 ext. 8276 <br />informed of the construction status so he may also meet his dbligations under Rule 9.C. <br />Please submit "As-Constructed" mylaz drawings, including the original certification sheet and one set <br />of blueline drawings, upon completion of construction. Final acceptance of the construction will be contingent <br />upon receipt and our acceptance of the "As-Constructed" drawings, as well as the other requirements of Rule 10 <br />(copy enclosed) of the Rules and Regulations.
