Ferguson, who opposes the granting <br />of a permit to the Hazeltine Investment Association so that it may <br />commence mining operations on property adjoining Mrs. Ferguson's. <br />The Hazeltine application was considered by the Mined Land <br />Reclamation Board on October 28th of this year. Mrs. Ferguson and <br />certain others appeared to oppose granting of the application. I <br />was unable to appear at that hearing, but Mrs. Ferguson informed me <br />that the Board did not hear evidence because no evidentiary hearing <br />had been scheduled for that day, but that a hearing would be held on <br />November 22nd. Today I called Mr. Randy Overton, of your office, <br />to find out what time that hearing would commence. He informed me <br />that consideration of the Hazeltine application will resume at 9:00 <br />a.m. on Tuesday, November 22nd, but that an evidentiary hearing is <br />not scheduled to take place at that time. <br />It is our understanding that the applicant is prepared to <br />offer testimony in support of its application, including the testimony <br />of one or more expert witnesses. Mrs. Ferguson and some of the other <br />property owners in the vicinity of the proposed mining site do wish to <br />have an opportun~i~ to make their views known to the Board and to pre- <br />sent evidence $e° ~~ testimony of an hydrologist. <br />n <br />On behalf of Tors. Ferguson, I request that an evidentiary <br />hearing be held by the Board so that the foregoing evidence may be <br />presented.
