OF MINERALS <br />8 GEOLOGY <br />RE: SPECIAL USE PERMIT N0.98-06, VIOLATIONS OF CONDITIONS OF <br />APPROVAL <br />Deaz Mr. Kirkland <br />Please be advised that Kirkland Construction is conducting activities in violation of several <br />conditions of approval for Special Use Permit No. 98-06, on property addressed as 57935 East <br />Highway 50, Boone, Colorado, and owned by Cazl Pantaleo. Special Use Permit No. 98-06 to <br />allow the extraction of sand and gravel, and a wash plant, was approved by the Pueblo County <br />Planning Commission February 24, 1998, with twelve (12) conditions of approval (attached). <br />This Department is aware that Kirkland Construction has been hauling extracted materials from <br />the site since at least June 8, 1998. Such activity is in direct violation of Condition Nos. 4 and 5 <br />of the Special Use Permit. Kirkland Construction is also operating in violation of Condition Nos. <br />3 and 8 of the Special Use Permit. <br />Condition No. 4 requires that prior to any mining activities commencing, the applicant shall <br />submit a detailed, scaled mine-site plan which identifies the location of all electric utility lines, <br />support structures, water wells, water lines, and gas/oil pipelines traversing the property, and all <br />200' safety buffers around such amenities. As of this date, this Department has not received <br />the required mine site plan. <br />Condition No. 5 requires that, prior to extraction activities commencing, the applicant shall <br />submit a detailed mining operations plan, which identifies the sequence and directions the <br />mining activity will follow.
