Gattany <br />Division Director <br />Natural Resource Trustee <br />As indicated to you in our telephone conversation this morning, the Division has identified a <br />deficiency in the approved Exhibit 7-20, Post Mine Channel Profiles. Please address the <br />following additional comments and incorporate your responses into the pending Midterm Review <br />revision (Technical Revision No. 37). A separate technical revision may be submitted if <br />necessary. Please consider the following comments as an addendum to the pending Midterm <br />Review No. 5 adequacy questions Items (1-6): <br />7. In accordance with Rule 2,05,3(4)(a)(ii), please provide registered professional engineer <br />certifications for all post mine drainage channel designs. Certifications were provided for the <br />new or revised post mine channel designs recently approved with Technical Revision No. 36. <br />However, professional engineer certifications were never provided for all the other post mine <br />channel designs contained in the permit document including: PM-2 through PM-6, PM-7, PM-8, <br />PM-10, PM-I1, PM-13, PM-14, PM-16, PM-19 through PM-21, and PM-23. <br />8. In accordance with Rule 4.05.4, please ensure that construction of all diversions which <br />drain a watershed of at least one square mile above the diversion are certified by a qualified <br />registered professional engineer. An As-Built Certification will be required for these applicable <br />channels to effect compliance with Rule 4.05.4(2).
