transmission line; however, the proposed highwall mining plan is designed for zero subsidence <br />(proposed Page 4.23-3 of the Permit Application Package). <br />Rule 4.23.2(7)(a) Auger mining shall be conducted in accordance with the backfilling and <br />grading reguirements of 4.14. <br />The application is in compliance with this rule. Surface topography is to be brought to previously <br />approved postmining contour for the surface pit mining, just as if no highwall mining had <br />occurred. <br />Rule 4.23.2(7)(6) Where auger mining operations affect previously mined areas that were not <br />reclaimed to the standards of these rules and the volume of all reasonably available spoil is <br />demonstrated in writing to the Division to be insufficient to completely bac1~11 the highwall, the <br />highwall shall be eliminated to the maximum extent technically practical in accordance with the <br />following criteria: <br />The application is in compliance with this rule by excepfion.
