Long <br />~ivision Director <br />Dear Mr. Varna, <br />This answers Brad Janes' letter of December 3 and Joby Adams' October 30, 2001 letter requesting <br />extraction of the coal fly ash pilot project area from the permit area. <br />The request can be granted, and [he area extracted from [he permit boundary as soon as [he Division <br />receives proof that Varna has notified the present landowner and the county commissioners as required <br />under Rule 4.16. Obviously, if Varna can demonstrate that they presently own the land in question, no <br />proof of notification of the landowner will be required. Please post the extracted area in the field so that <br />inspectors will recognize it in the future. <br />I apologize for any inconvenience and any apparent duplication of effort. However, because our permit <br />files list you as the permit contact, rather than Joby or Brad, it is requued that release requests come from <br />you as [he contact for Vats Companies. If you would like to change the permit contact and avoid this <br />inconvenience in the future, please contact me and I will be sure that the records reflect the proper contact. <br />I have noticed [hat all of Varna Companies' listed contacts aze either you or Varna Companies alone. If you <br />care to designate a single permit contact for all Varna operations, I can handle [he record changes for you <br />all at once. <br />Mr. Janes' letter included a map, labeled Figure 3, showing the study area relative to the mine permit. On <br />that map was an inset map, labeled "Exhibit D Coal ash wench and monitoring well location plan", upon <br />which are shown several "proposed monitoring well location" points. Although the letter indicated that the <br />area comprises 1.43 acres, I believe that figure was calculated to include only [he inscribed wells, and not <br />the wells plus the 50 foot buffer zone as described in the letter. The Division will presume that the <br />exclusion area will be marked in the field and will include the buffer zone.
