3 <br />~ '~`' <br />Judge Boulden's Courtroom located on the third floor of the <br />Federal Courthouse Building located at 350 South Main Street, <br />Salt Lake City, Utah. The Motion requests approval of a <br />settlement of the above-captioned adversary proceeding between <br />the parties. CF&I brought this action against Mountain States <br />alleging that certain transfers made to it constitute avoidable <br />preferences under 11 U.S.C. § 547(b). The parties have aclreed to <br />settle the matter with Mountain States making a payment o1' <br />530,000.00 to the Debtors' estates. In addition, the settlement <br />contemplates allowing Mountain States a general unsecured claim <br />in the amount of 530,000. Other details respecting the <br />settlement may be obtained by reading the Motion and Settlement <br />Agreement. Copies of the Motion and the related Settlement <br />Agreement may be obtained by request from the undersigned counsel <br />for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 5.23 (b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Friday, December 30y <br />1994. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motior.•. may <br />be granted by the Court without further notice of hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sought in <br />2 <br />
