Response: <br />The enclosed "Report on Site Conditions" describes the features included in the <br />Permit. The nearby pre-Law vent hole is described in the enclosed report. Other pre-Law <br />vent holes in the general vicinity are described in the Sunday Mine information package <br />submitted by the Operator on February 6, 2003. <br />Pre-Law Features on Man: <br />The old mining features in the northwest corner of the Permit area may be removed <br />from the map, but can be left if it makes the picture clearer. <br />Response: <br />The Old Carnation Portal is located on the new map submitted herewith. It is not <br />specifically identified as "pre-Law" on the map; this distinction can be added if the Division <br />requests. <br />Waste Rock Dump Desienations: <br />The brown hachured areas on the draft map are assumed to be waste rock dumps. <br />Response: <br />The new map submitted herewith has a clearly labeled Legend identifying map <br />features. <br />Reclamation Maps: <br />The Reclamation Map to be submitted by the Operator must depict those features <br />which will remain on site; features which are to be removed should not be shown on the <br />Reclamation Map. <br />Response: <br />No comment. <br />Affected Area Outline: <br />The disturbed area shown on the draft map exceeds the polygon of the affected area. <br />The affected area was never marked in the field, and boundary exceedances were not <br />previously known. It is not known if these areas were affected under a previous operator. <br />The affected area boundary should be reconfigured to include all disturbances outside of the <br />original Permit boundary. A revised map showing a "proposed boundary configuration" must <br />be provided for an area of the same acreage. <br />Response: <br />The Operator was unaware that past mining-related disturbances exceeded the <br />boundary of the original Permit Affected Area shown on the 1979 map. The current Operator <br />has not expanded the disturbed area beyond the area that was disturbed by previous operators <br />under the Permit. <br />The Operator is submitting a "Proposed Affected Area" boundary on the attached <br />map. The Proposed Affected Area is 9.76 acre; the original permit area was reported as 9.78 <br />acres. The Proposed Affected Area includes areas disturbed under modern mining operations; <br />historical mining areas are outside the Proposed Affected Area. The Proposed Affected Area <br />has been configured to not only encompass disturbed areas, but also to include all area that <br />will be included in the reclamation plan for this Permit. <br />The pre-existing exceedances of the original Permit boundary all fall within valid <br />mining claims controlled by the Operator. The Operator has the right of ingress and egress to <br />all of the area shown within and adjoining the Proposed Affected Area boundary. <br />4 <br />
