D°o!. of Naturzl F.esources <br />~; <br />THIS AGREEf•1ENT made and entered into this 4, .- day <br />of July, 1983, by and between the City of Lakewood, Colorado, <br />a municipal corporation of the State of Colorado, hereinafter <br />referred to as "Lakewood", and Robinson Brick Company, a Colorado <br />corporation, Denver, Colorado, hereinafter referred to as "Robco." <br />47ITNESSETH: <br />THAT [4HEREAS, Lakewood is the owner of certain lands <br />situate in Sections 24, 25, and 26, Township 4 South, Range 70 <br />[Vest of the Sixth P.M., City of Lakewood, Jefferson County, <br />Colorado, lying south of West Alameda Parkway, as more fully <br />described in exhibit "A", attached hereto and made a part hereof; <br />and, <br />WHEREAS, Robco is the ocaner of the mineral interests <br />and rights within and upon said real estate, and is Lessee under <br />a certain clay land lease dated July 12, 1939 by operation of <br />law merged into a certain clay land lease dated April 1, 1997, <br />and a silica sand lease dated July 1, 1997, the two latter <br />leases involving clay and silica sand mining on the aforedescribecl <br />real estate; and, <br />[•7HEREAS, Lakewood is desirous of having Robco release <br />from said leases a portion of the aforedescribed lands owned by <br />Lakewood and receiving a mineral deed from Robco for its mineral <br />interests and rights in a portion of the aforesaid lands; and, <br />WHEREAS, Robco has represented to Lakewood that it has <br />acquired and has the authority to convey to Lakewood all mineral <br />interests underlying the land owned by Lakewood as shown in <br />exhibit "A", whether severed, reserved, leased or otherwise; and, <br />WHEREAS, Robco is desirous of continuing to mine and <br />remove clay and silica sand consistent with the aforesaid leases <br />from and upon a portion of said lands and contiguous lands; and, <br />[VI{EREAS, Robco is desirous of amending its application <br />for a 112 Dlined Land Reclamation permit to include a portion of <br />the aforesaid land not released from said leases and mineral <br />
