A summary of compliance with the specific criteria is set forth below: <br />a) in order to demonstrate that the quality of the irrigation runoff water stored in the impoundment <br />would be suitable for wildlife and livestock use, the Division required the operator to sample the <br />pond water and submit analyses of the sample for pH, TDS, chloride, sulfate, sodium, lead, <br />cadmium, nitrate, nitrite, boron, arsenic, clu-omium, copper, selenium, zinc, and aluminum. <br />Operator sampled the pond on May 29, 1997, and the requested analyses were reported in the <br />1997 Annual Hydrology Report, dated November 18, 1997. In all cases, the parameter values <br />were well below published "suspect levels" for stock water use, indicating that water quality <br />would be suitable for its intended use. <br />b) Irrigation runoff water provides for a reliable source of water during the growing season. The <br />pond contained a pool of clear water extending from the dam to the inlet at the time of the bond <br />release inspection, on December 1, indicating that the water level will be sufficiently stable to <br />extend the period of available water on site for a significant period of time. The configuration <br />of the pond is adequate to support the intended use, as evidenced by the numerous tracks of deer <br />and small animals along the edges of the water pooled in the pond. <br />c) There are no cliffs or steep drop-offs adjacent to the pond, or other impediments to safe access. <br />d) Operator provided documentation in the permit application and bond release application <br />demonstrating that water storage in the impoundment would not be in conflict with state law <br />pertaining to water rights. <br />e) Information provided in the permit application and the bond release application, including P.E. <br />certifications, document that the design and construction are in compliance with applicable <br />criteria. The pond has required minimal maintenance during the liability period, and fitture <br />maintenance needs would be expected to be minor and infrequent. <br />t) Information provided in the permit application and the bond release application, including P.E. <br />certifications of the spillway system, document compliance with the applicable criteria. <br />g) The pond is large enough to provide a water source for wildlife during periods of the year when <br />water would otherwise not be available on site. <br />h) The impoundment is suitable for the approved postmining land used of wildlife habitat. <br />i) The impoundment is not located within a former mine pit, and thus contains no highwall. <br />In conclusion, based on documentation contained in the permit application and the bond release <br />application, and based on observations made during the bond release inspection and throughout the <br />liability period, the impoundment is in compliance with all applicable permanent impoundment criteria. <br />Provisions for sound future maintenance by the landowner/permittee (MINREC, INC.) have been <br />
