Mining Plan Approval Document No. CO-0068 <br />Page 2 of 3 <br />Section 20: A parcel described as follows: Beginning at <br />the NE section corner of said Section 20 as monumented by a <br />General Land Office brass cap and considering the line <br />between said NE section corner and the N ; corner of said <br />Section 20, as monumented by a General Land Office brass <br />cap, to bear N 87° 10' 19" W, and running thence N 87° 10' <br />19" W along the north line of the NE4 of said Section 20, <br />2623.15 feet to the said N ; corner of Section 20; thence N <br />84° 39' 40" W along the north line of the NW 2 corner of <br />Section 20, 236.00 feet; thence S 03° OS' 34" W, 630.00 <br />feet; thence S 87° 10' 19" E, 910.00 feet; thence S 03° OS' <br />34" W, 660.00 feet; thence S 87° 10' 19" E, 1948.88 feet to <br />a point on the east line of the said NE4 of Section 20; <br />thence N 03° OS' 34" E along said east line of the NE 4 of <br />said Section 20, 1279.64 feet to the said NE section corner <br />of Section 20 and the point of beginning. <br />as shown on the map appended hereto as Attachment A. <br />3. The operator shall conduct coal development and mining <br />operations only as described in the complete permit <br />application package, and approved by the Colorado Division <br />of Minerals and Geology, except as otherwise directed in the <br />conditions of this mining plan approval. <br />• 4. The operator shall comply with the terms and conditions of <br />the leases, this mining plan approval, and the requirements <br />of the Colorado Permit No. C-81-033 issued under the <br />Colorado State program, approved pursuant to the Surface <br />Mining Control and Reclamation Act of 1977 (30 U.S.C. 1201 <br />et seg.). <br />5. This mining plan approval shall be binding on any person <br />conducting coal development or mining operations under the <br />approved mining plan and shall remain in effect until <br />superseded, cancelled, or withdrawn. <br />6. If during mining operations unidentified prehistoric or <br />historic resources are discovered, the operator shall ensure <br />that the resources are not disturbed and shall notify <br />Colorado Division of Minerals and Geology and the Office of <br />Surface Mining Reclamation and Enforcement (OSM).
