The Motion requests approval o:E <br />a settlement of this adversary proceeding between the parties. <br />CF&I brought this action against Midwesco alleging that certain <br />transfers made to it constitute avoidable preferences under 11 <br />U.S.C. § 547(b). The parties have agreed to settle the matter with <br />Midwesco making a payment of $6,500 and being permitted to file an <br />unsecured claim in the same amount or an amended unsecured claim <br />including such an amount. Copies of the Motion and the related <br />settlement agreement may be obtained by request from the <br />undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 523(b) of <br />the Rules of Practice of the United States Bankruptcy Court for the <br />District of Utah, objections to the Motion must be submitted in <br />writing, filed with the Bankruptcy Court, and served upon the <br />undersigned counsel on or before Tuesday, the 13th day of July, <br />1993.
