Cattany <br />Division Director <br />NaNral Resource Trustee <br />RE: Backtill Notice -Reclamation Costs, Platte Valley Operation, Permit No. M-1989-120 <br />Dear Ms. Davis: <br />Thank you for your Inert Fill Backfill Notice, as per Rule 3.1.5(9), received on September 21, <br />2005. Approval of your notice will be contingent upon verification that the operation is <br />adequately bonded for such activity. Review of the permit file indicates that the site is bonded <br />for backfilling of 8066 cubic yards of overburden materials, per Amendment No. 1. Please <br />verify, on or before October 21, 2005 the following information: A) The maximum volume of <br />inert structural fill to be backfilled on site at any one time and how this material will be <br />reclaimed, ie: Will the inert fill need to be covered with overburden and/or topsoil?, and B) Are <br />there any provisions in the existing reclamation cost estimate for backfilling of inert materials? <br />If so, what is the volume of material accounted for? If not, the existing reclamation cost and <br />bond will need to be increased by an amount equal to the cost of reclamation of the maximum <br />volume of inert material to be stored on site at any one time. <br />Once again, we look forward to your response on or before October 21, 2005. <br />Sincerely, <br />Thomas A.
