It was assigned to Western Fuels-Utah, Inc., effective June 1, 1981. The <br />lease was readjusted March 1, 1983, and an adjustment of the lease boundary to include an <br />additional 40 acres was effective October 9, 1991. The lease is part of the Deserado Mine <br />Logical Mining Unit that was approved effective September 16, 1985. Coal lease <br />C-023703 is subject to its second readjustment of terms and conditions on March 1, 1993. <br />Notice of intent to readjust coal lease C-023703 was sent to the lessee, Western Fuels-Utah, <br />Inc., on Mazch 1, 1991. As provided in the Mineral Leasing Act of 1920, as amended <br />(41 Stat. 437, 30 U.S.C. 181 et seq.), the regulations, and Sec. 23 of the 1983 readjusted <br />lease, we aze hereby readjusting the terms and conditions of lease C-023703. A copy of the <br />readjusted lease is enclosed. The readjusted terms and conditions shall become effective <br />Mazch 1, 1993. <br />On February 21, 1992, the eight percent royalty rate for coal removed from an underground <br />mine was reduced to five percent and the rental was waived for a period of two years <br />effective May 1, 1991. When the royalty rate reduction and waiver of rental ceases, the <br />standard rates as provided in the readjusted lease will apply. The annual rental will remain <br />$3 per acre or fraction thereof. The royalty rates established by law and by regulation at <br />Title 43, Code of Federal Regulations (CFR), Subpart 3473.3-2, will remain at 12~f~ percent <br />of the value of the coal removed from a surface mine and 8 percent for coal removed from <br />an underground mine for all lands in the lease.
