Company, Colorado ~ Utah Land Company, and Fueblo Rai'_road
Service Company, each as debtor and debtor in possession
(individually and collectively, "Debtors"), by their counsel,
LeBoeuf, Lamb, Leiby 6 MacRae, hereby move the Court, pursuant to
11 U.S.C. § 1121(d), for an Order (a) extending from March. 7,
1991 to July 5, 1991 the exclusive period for the filing of
Debtors' plan or plans of reorganization ("Exclusive Filing
Period"}, and (b) extending from May 6, 1991 to September 3, 1991
the exclusive period for Debtors' obtaining acceptances of° their
plan or plans of reorganization ("Exclusive Acceptance
Period").z In support of this Motion, Debtors state as follows:
1. The Court has jurisdiction over this matter pursuant
to 28 U.S.C. §§ 157 and 1334. This is a core proceeding pursuant
to 28 L.S.C. § 157(b)(2).
2. On November 7, 1990, Debtors commenced their
reorganization cases by filing voluntary Chapter 11 petitions.
3. Debtors are continuing in possession of their
respective property and are operating and managing their
respective businesses as debtors in possession pursuant to 11
U.S.C. §§ 1107 and 1108.
1. One of CF&I Steel Corporation's subsidiaries which filed a
chapter 11 petition and whose case is jointly administered with
the Debtors' cases, The Colorado and Wyoming Railway Comp, sny, is
not a party to this Motion because a trustee has been appointed
in that case as required by 11 U.S.C. § 1163.
2. Debtors recognize that they may need to request additional
extensions of these periods (and reserve the right to do so) but
in this Motion seek only an initial 120-day extension of each
period.
2
