All notices, requests or other communications required or permitted to be made in accordance with this Trust Agreement and the Plan, shall be in writing and shall be delivered personally or by telex or other telegraphic means or mailed by first class mail to: 7.2 Effectiveness. This Trust Agreement shall become effective upon the Effective Date of the Plan. 7.3 Counterparts. This Trust Agreement may be executed in one or more counterparts, all of which shall be taken together to constitu[e one and the same instrument. 7.4 Governing Law. Any provision of this Trust Agreement which is prohibited or unenforceable in any jurisdiction shall not invalidate the remaining provisions hereof, and any such prohibition or unenfott;eabiliry in any jurisdiction shall not invalidate or render unenforceable any such provision in any other jurisdiction. 7.7 Entire Agreement. This Trust Agreement (including the Recitals), the Plan, and the Confirmation Order constitute the entire agreement by and among the patties and there are no representations, warranties, covenants or obligations except as set forth herein or therein. This Ttvst Agreement, the Plan and the Confirmation Order supersede all prior and contemporaneous agreements, understandings, negotiations, discussions, written or oral, of the parties hereto, relating to any transaction contemplated hereunder. Except as otherwise specifically provided herein, in the Plan or in the Confirmation Order, nothing in this Trust Agreement is intended or shall be construed to confer upon or to give any person other than the parties thereto and their respective heirs, administrators, executors, successors, or assigas any right to remedies under or by reason of this Trust Agreement. 7 Effect of Death. incapacity or Bankruotcv of Beneticiarv.
