Box 772 <br />Gunnison, Colorado 81230 <br />~II II~II~II~"~~ II~ <br />DIVISION <br />RE: Perinittee and Operator Responsibilities at Ohio Creek ~2 Coal Mine <br />Dear Ms. McCormick and Mr. and Mrs. Weaver: <br />The purpose of this letter is to advise you of certain obligations which <br />must be met when operating a coal mine in Colorado. I am writing this <br />letter in response to written correspondence and several phone calls to <br />the Division concerning operation of the Ohio Creek No. 2 Coal Mine <br />pending resolution of a legal dispute between you. <br />The Colorado Surface Coal Mining Reclamation Act sets forth - <br />responsibilities and obligations for coal mining. In this case, Sylvia <br />McCormick was named as the pennittee and operator of permit No. C-002-80 <br />for the Ohio Creek #2 Mine through the attached "Request for Transfer of <br />Permit and Succession of Operators" approved by the Division on March 7, <br />1983. This obligates Ms. McCormick to comply with all terms of the <br />permit and applicable state laws and regulations. This legal obligation <br />has not changed. Therefore, we consider ^1s.
