A commitment to remit payment to the
Recovery Program Fund (formerly referenced as the "Windy Gap Process" fund) for MCC's
additional depletion, was included in Permit Revision No. 5 to MCC's Permit No. C-80-007
approved by the Colorado Division of Minerals and Geology. That additional depletion is 17.1
acre feet. (The updated depletion of 29.0 acre feet -the former depletion of 11.9 acre feet paid to
the fund in August, 1985 = 17.1 acre feet.) Based on the contribution amount of $12.34 per acre
foot of depletion, MCC's total additional contribution is $21 I.OI. A check in that amount is
enclosed.
Please contact me should you have questions.
Sincerely,
~~~~~e„r~Jl~2c~7`
Kathleen G.
