Long <br />Division DireUOr <br />Ae briefly discussed on October 26, 1992, Steve Powell of Western Fuels <br />Colorado expressed concerns on Murari Shretha's behalf regarding the slated <br />Inactive Mine Nucla Project. The main issue is Western Fuels receiving a <br />Notice of Violation related to sediment problems which would occur associated <br />with the Inactive Mine reclamation work. This primarily stems from the <br />sensitivity of Western Fuels inheriting a sediment related NOV from Peabody. <br />As told to Mr. Powell, our design work as applied in field will take all <br />precautions necessary to avoid any off-site sediment loading through the use <br />of contour furrowing and dozer basin construction. As well, I informed him <br />that during the final grading stages, he is more than welcome to come on-site <br />to express hie input if he feels that off site sediment may still pose a <br />problem from hie perspective. Mr. Powell would like to obtain a waiver from <br />Title V personnel if an NOV would be issued and could be exclusively directed <br />at the Inactive Mine Project. This appears to be a condition before Western <br />Fuels will consent to reclamation activities for the pre-law area. <br />Reclamation Construction is slated for early '93. Thanks. <br />
