<br />Summary <br />The Review Process <br /> <br />On February 22, 1991, the Division advised Pittsburg & Midway that the coal <br />mining permit at the Edna Mine would expire on November 16, 1991. The <br />Division received a renewal application from Pittsburg & Midway on <br />May 13, 1991. The applicant's right to continue to conduct mining operations <br />beyond the expiration of the previous permit was thereby ensured. The <br />application was deemed complete on May 20, 1991. The Division solicited <br />comments from regulatory authorities in other states regarding the compliance <br />status of Pittsburg & Midway on May 24, 1991, and on January 30, 1992. No <br />compliance problems were reported. The Applicant Violator System (AVS) was <br />queried on May 21, 1991, February 19, 1992, and July 26, 1992. The system and <br />the Office of Surface Mining indicated no compliance problems or unpaid AML <br />fees were associated with Pittsburg & Midway. <br />On July 3, 1991, the Division received comments concerning the permit renewal <br />from the State Historic Preservation Office (SHPO). SHPO requested that, <br />should the permit renewal include plans for additional disturbance, <br />Pittsburg & Midway conduct a cultural resources survey for lands to be <br />disturbed. The permit renewal does not encompass plans for additional <br />disturbance. <br />No other comments regarding the permit renewal were received from government <br />agencies. <br />Pittsburg & Midway published its intent to renew in the Steamboat Pilot once <br />per week for four weeks, beginning June 13, 1991. No comments from the public <br />were received during the thirty-day period following publication. <br />On December 26, 1991, the Division received updated application materials from <br />Pittsburg & Midway. On February 10, 1992, the Division forwarded comments of <br />its preliminary adequacy review to Pittsburg & Midway. A February 17, 1992 <br />submittal by Pittsburg & Midway resolved all Division concerns. The Division <br />reviewed Annual Hydrology Reports submitted by Pittsburg & Midway for the <br />1966-1991 Edna Mine permit term, resulting in a stipulation (Stipulation 32) <br />on its decision. Details concerning the review are found in the Hydrologic <br />Balance and Alluvial Valley Floor discussion of this document. Permit <br />deficiencies identified during the midterm review were addressed in Technical <br />Revision 19 to the mine permit, approved October 27, 1991. Other revisions to <br />the permit during this term include Permit Revision O1, the revised Moffat <br />Area Mining and Sedimentation Control Plans, and Permit Revision 02, the West <br />Ridge Hydrologic Reconstruction Plan. <br />Publication of this proposed decision initiates a thirty-day public comment <br />period. Provided there are no objections to the renewal, the decision becomes <br />final at the close of the public comment period. <br />-6- <br />
