Response to Comments <br />Chapter 8 <br />The first stiptrlatton in this section should be removed. MCC suggests the term "sensitive srrrrctrrres" is subjective. Agapito <br />has evaluated the srretures implied with conclusions that these sh7rchmes, with appropriate mitigation measures in place, <br />will not be negatively impacted by subsidence. <br />For the second stipulation under this section, MCC's monitoring and mitigation plans in the COMG permit will include <br />measures to resolve airy potential overflow issues with streams and ditches. The mine plan wilt be designed, to the extent <br />possible and as determined by MCC, to minimize such impacts. Ijimpacts occur, they will be mitigated according to the <br />reproved COhIG permit. <br />The third stipulation under this section is not acceptable m MCC. Mine plan schedules are dynamic and ever changing. It is <br />not practico! to schedule mining activities, specifically longwall mining, as suggested by this stipulation as written. MCC <br />suggests this stipulation be re+noved, as the matitoring and mitigation requirements ojthe CDMG permit will adequately <br />address this issue. <br />MCC suggests that the third sentence ojthe fourth stipulation in this section be revised to read: "The plan will be submitted <br />to the Fores7 Service no later than 12 months prior to the scheduled «ndermintng ojthese roads and structures jot review <br />and acceptance by FS and MCC. <br />In summary, MCC is only interested in Altemative B, the proposed action. MCC is concerned that Altemative C <br />will potentially attract unwarranted attention. MCC encourages [he FS to remind and emphasize to parties <br />supportinP Altemative C that MCC has successfully undermined Deeo Creek with no observable subsidence <br />imoaets (summary comment) <br />MCC invites an exchange of ideas and discussion to resolve these concerns listed above to our mutual <br />satisfaction.
