Long <br />Division Director <br />RE: Formal Public Hearing, Revocation of Hgghwall Settlement Agreement, Apex No. 2 <br />Mine, Sunland Mining Corp., File No. C-81-011 <br />Dear Mr. Harman: <br />On September 23, 1993 the Mined Land Reclamation Board (MLRB) revoked the <br />settlement agreement between the Division of Minerals and Geology, and the Sunland <br />Mining Corporation. This settlement agreement, signed last fall, allowed portions of the <br />hi hwall to remain as pazt of the approved reclamation plan. Enclosed is a copy of the <br />Board order. <br />As you know the Division is pursuing a State Rule change that will grant exemptions for <br />highwall reclamation in specific circumstances such as with the Apex mine. However, to <br />keep the Apex mine in compliance during the interim before the Rule change, and to avoid <br />Federal enforcement action, Sunland must submit a technical revision committing to <br />reclaiming the highwall per Rule 4.14.2(1)(b). This revision must be submitted before <br />November 15, 1993. I have discussed the format of the revision with Greg Lewicki. The <br />submittal can be an insert page in the permit application committing to reclaiming the <br />highwall per Rule 4.14.2(1)(b) at a specified future date. Upon approval of the change to <br />Rule 4.14.2(1)(b), another technical revision can be submitted reversing the previous <br />technical revision. <br />If you have any questions please feel free to call me. <br />Sincer y, <br />~~ ~ ~ <br />Randall P.
