Summary and Conclusions <br />Based upon a review of the mine permit, the applicant's bond release application, and site inspections, <br />the Division finds that TMI has replaced topsoil in accordance with the approved reclamation plan. The <br />Division further finds that TMI has established vegetation which supports the approved post mine land <br />use and meets the approved success standard for vegetative cover. The Division further fords that the <br />reclaimed area subject to this bond release is not contributing suspended solids to streamflow or runoff <br />outside the permit area in excess ofpre-mining levels or in excess of adjacent nonmined areas. <br />IV. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve Trapper Mining Company's request <br />for a partial Phase II bond release for the Trapper Mine. This proposed decision will release the <br />applicant from liability for topsoil redistribution and establishment of vegetation in accordance with <br />Phase II bond release criteria on bond release blocks CR 82-92 and CR 93-94 totaling 592.7 acres. <br />PHASE II <br />The original performance bond for the Trapper Mine was $18,279,608.00. In the two preceding bond <br />releases, SL-Ol and SL-02, the Division released the liability on the bond release blocks but did not <br />return any monies to the operator. The previous bond releases applied to the backfilling and regrading <br />of 2511.7 acres of lands associated with the Ashmore, Browning/Colt, Derringer and Enfield pits. TMI is actively mining coal. Reclamation at the Trapper Mine continues as pits continue to <br />progress. On active mine areas, backfill and grading, topsoil redistribution, and seeding and <br />transplanting will continue. On bond release blocks CR 82-92 and CR 93-94 included in this bond <br />release application (SL-03), no additional work needs to be conducted at this time. <br />Trapper Mine, SL-03, Findings a April 19, 2002 <br />
