On September 20, 1985 the informal conference was held in accordance with
Rule 3.03.2(4). Present at the meeting were representatives of the Division,
Sun Coal, and the landowner. Outstanding issues were discussed, including
those raised in the landowner's request for conference letter of
August 22, 1985. Upon the agreement of all parties, the conference was
officially left open until October 18, 1985 to allow Sun Coal Company to
submit additional technical information. This was confirmed in writing in a
Division letter dated September 25, 1985.
On September 25, 1985 the Division received a letter from Sun Coal requesting
written clarification of what further information was required by the Division.
On October 9, 1985 a meeting was held between the Division and Sun Coal to
discuss the technical information required. A draft submittal of information
was discussed, with the final draft being submitted on October 31, 1985. This
submittal discussed the applicant's interpretation of the Rules and
Regulations pertaining to bond release, and did not contain the technical
information which the Division had requested.
On October 11, 1985 the Division received a request from Sun Coal to extend
the deadline for submitting information. The extension was granted for an
indefinite period in a letter from the Division dated October 25, 1985.
On October 24, 1985 the Division sent a detailed written description of the
technical information which remained outstanding to Sun Coal.
On December 20, 1985 the Division responded to Sun Coal Company's submittal of
October 31, 1985.
On January 2 and January 22, 1986 the Division received additional technical
responses from Sun Coal Company.
The informal conference was reconvened on January 22, 1986. Representatives
of the Division, Sun Coal Company, and the landowner were present. The
informal conference was officially closed at the end of this meeting.
The Division has reviewed the bond release application, technical submittals,
landowner comments, and the Division inspection reports as the basis for this
proposed decision which was affirmed as final by the Board on May 22, 1986.
